These Terms and Conditions ("Terms," "Terms of Service," or "Agreement")
govern access to and use of the website located at
https://www.plugmachine.com and the products, software, communications
tools, communities, training, templates, support, and other services
made available by Fearlyss LLC dba Plug Machine ("Plug Machine,"
"Company," "we," "us," or "our").

Please read these Terms carefully before accessing or using Plug
Machine. By accessing the website, creating an account, purchasing a
subscription or product, submitting information through a form, using
our software or services, participating in our community, or otherwise
using the Services, you acknowledge that you have read, understood, and
agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you should not access or use the
Services.

LLC doing business as Plug Machine.

2. DESCRIPTION OF SERVICES

Plug Machine provides technology, education, software access, business
systems, and related resources that may include customer relationship
management ("CRM") functionality, sales funnels, websites, forms,
surveys, calendars, appointment scheduling, contact management, pipeline
management, workflow automation, email tools, SMS and telephone
functionality, reporting, integrations, artificial intelligence
features, communities, courses, educational content, templates, support
resources, consulting, implementation assistance, and other digital
products or services.

Specific features available to you depend on the plan, subscription,
promotion, purchase, or agreement applicable to your account.

Certain portions of the Services may be provided through, powered by,
connected to, or dependent upon third-party platforms and
infrastructure. Third-party functionality may be subject to separate
terms, acceptable-use policies, registration requirements, fees,
technical limitations, carrier requirements, or availability.

Plug Machine may add, remove, modify, replace, limit, suspend, or
improve features from time to time. We do not guarantee that every
feature will remain available indefinitely or that third-party
integrations will remain unchanged.

3. ELIGIBILITY

You must be at least eighteen (18) years old and legally capable of
entering into a binding agreement to use the Services unless applicable
law permits otherwise.

If you access or use Plug Machine on behalf of a company, organization,
client, or other legal entity, you represent that you have authority to
bind that entity to these Terms.

You may not use the Services if your use would violate applicable law,
regulation, sanctions, court order, contractual restriction, or another
legally binding obligation.

4. ACCOUNT REGISTRATION

Some Services require an account. You agree to provide complete,
current, and accurate information when registering and to update that
information when necessary.

You are responsible for safeguarding usernames, passwords,
authentication credentials, API keys, and other account-access
information. You are responsible for activity occurring through your
account to the extent permitted by law.

You agree to notify Plug Machine promptly if you reasonably believe your
account or credentials have been compromised.

We may require identity, business, tax, telephone, email, domain,
payment, or other verification to provide particular Services or satisfy
legal, carrier, payment-processor, telecommunications, fraud-prevention,
or platform requirements.

5. SUBSCRIPTIONS AND RECURRING BILLING

Certain Plug Machine Services are offered on a recurring subscription
basis.

By purchasing a recurring subscription, you authorize Plug Machine and
its payment processors to charge the payment method you provide at the
interval and price disclosed at checkout, on an order form, or in
another applicable agreement until the subscription is canceled.

Your subscription may automatically renew at the end of each billing
period unless canceled before the next renewal date.

You are responsible for maintaining a valid payment method. Failed,
declined, reversed, disputed, expired, or otherwise unsuccessful
payments may result in restricted, suspended, or terminated access.

Prices may change. Where required, we will provide notice before a
pricing change becomes effective for an existing recurring subscription.

6. USAGE-BASED AND THIRD-PARTY CHARGES

Some Services may incur charges separate from a base subscription. These
may include, where applicable, SMS usage, telephone usage, email usage,
phone-number rental, artificial intelligence usage, premium workflow
actions, domains, email verification, A2P registration, carrier fees,
telecommunications fees, payment-processing fees, premium integrations,
wallet funding, rebilling charges, or other usage-based services.

Such fees may be charged directly, deducted from a prepaid balance or
wallet, passed through from a third-party provider, or billed according
to the pricing disclosed in the applicable account or offer.

You are responsible for monitoring your usage and account balances.

7. FREE TRIALS, PROMOTIONS, AND DISCOUNTS

Plug Machine may offer trials, promotional rates, discounts, coupons,
credits, bonuses, or limited-time access.

The specific terms presented with an offer control that offer.
Promotional pricing may expire and convert to standard pricing if
disclosed at enrollment.

Unless expressly stated otherwise, promotional offers have no cash
value, may not be combined, and may be modified or discontinued for
future purchases.

8. CANCELLATION

You may cancel a recurring subscription through the cancellation method
made available for your plan or by contacting us when appropriate.

Cancellation prevents future renewal charges after the cancellation
becomes effective. Cancellation does not automatically entitle you to a
refund of fees already paid, usage charges already incurred, third-party
fees, registration fees, or services already delivered, except where
required by applicable law or expressly provided in a written refund
policy or offer.

You remain responsible for charges incurred before cancellation becomes
effective.

You should export any customer or business data you need before account
termination or expiration where export functionality is available.

9. REFUNDS

Unless a specific product, service, order form, proposal, checkout page,
or written agreement expressly provides otherwise, payments are
non-refundable to the maximum extent permitted by law after access,
software, digital products, implementation, consulting, customization,
usage-based services, or other Services have been provided or begun.

Nothing in this section limits rights that cannot legally be waived.

10. CUSTOMER RESPONSIBILITIES

You are responsible for your business and your use of Plug Machine.

You are responsible for the legality, accuracy, quality, integrity,
permissions, and appropriateness of content, data, contacts, offers,
advertisements, products, services, communications, automations,
websites, funnels, forms, campaigns, and other materials that you
create, upload, import, transmit, publish, or process through the
Services.

You are responsible for complying with laws and rules applicable to your
activities, which may include privacy, consumer-protection, advertising,
email, telemarketing, telecommunications, intellectual-property,
accessibility, tax, industry-specific, and data-protection requirements.

Plug Machine does not become responsible for a customer's legal or
regulatory obligations merely because the Services provide tools that
can be used to perform those activities.

11. CONTACT DATA AND CONSENT

You may only upload, import, collect, process, call, email, or message
individuals when you have the lawful right and any consent required to
do so.

You are responsible for maintaining appropriate records of consent and
honoring opt-outs, unsubscribe requests, suppression requests,
revocations of consent, and other legally required consumer choices.

You may not use scraped, harvested, unlawfully purchased, stolen,
fabricated, or otherwise improperly obtained contact information through
Plug Machine.

You may not represent that Plug Machine independently verified your
contact list or the legality of your outreach.

12. EMAIL COMMUNICATIONS

Email functionality may be subject to anti-spam laws, provider
requirements, reputation standards, authentication requirements,
suppression rules, and acceptable-use policies.

You agree not to send unlawful unsolicited commercial email,
misrepresent sender identity, use deceptive subject lines, evade
unsubscribe mechanisms, or knowingly transmit malicious or fraudulent
content.

Email deliverability, inbox placement, sender reputation, open rates,
click rates, and provider acceptance are not guaranteed.

13. PLUG MACHINE SMS MESSAGING PROGRAM

Program Name: Plug Machine SMS Messaging Program

The Plug Machine SMS Messaging Program allows individuals who
affirmatively opt in to receive recurring text messages from Fearlyss
LLC dba Plug Machine.

Depending on the specific consent you provide, messages may include
appointment confirmations and reminders, account alerts,
customer-service messages, service updates, educational information,
community or training reminders, product or feature announcements, event
information, special offers, discounts, promotional communications, and
marketing messages.

SMS Consent

By affirmatively opting in to the applicable Plug Machine SMS program,
you consent to receive recurring automated and/or non-automated text
messages at the mobile number you provide, consistent with the consent
language presented to you.

Consent to receive marketing text messages is not a condition of
purchase
.

Providing a telephone number without affirmatively opting in does not,
by itself, constitute consent to receive recurring marketing SMS
messages.

Message Frequency

Message frequency varies based on the messaging program, your
activity, your purchases, appointments, requests, account status, and
interactions with Plug Machine.

Message and Data Rates

Message and data rates may apply for messages sent to you from Plug
Machine and messages you send to Plug Machine. Contact your wireless
provider for information regarding your text or data plan.

SMS Opt-Out --- STOP

You can cancel the SMS service at any time. Text STOP to 757-290-8380
or reply STOP to a Plug Machine text message.

After you send STOP, we may send an SMS confirming that you have been
unsubscribed. After confirmation, you will no longer receive messages
from the applicable messaging program unless you subsequently opt in
again.

Where supported, other standard opt-out keywords may include END,
CANCEL, UNSUBSCRIBE, or QUIT.

If you want to rejoin, complete an applicable opt-in process again.

SMS Help --- HELP

If you are experiencing issues with the messaging program, reply HELP
for assistance. You may also contact Plug Machine at

Carrier Liability

Carriers are not liable for delayed or undelivered messages.

Delivery is subject to effective transmission by your wireless carrier
and other network providers. Plug Machine cannot guarantee that every
message will be delivered or delivered at a particular time.

Mobile Privacy

Your use of the SMS program is also governed by the Plug Machine Privacy
Policy.

Mobile information and text messaging opt-in information are subject to
the protections stated in our Privacy Policy. Plug Machine does not sell
or share SMS opt-in data or consent with third parties or affiliates for
their own marketing or promotional purposes.

14. A2P 10DLC AND TELECOMMUNICATIONS COMPLIANCE

Certain U.S. business messaging may require A2P 10DLC registration,
campaign approval, toll-free verification, identity verification, brand
verification, or other carrier/provider registration.

Approval is determined by third parties and is not guaranteed by Plug
Machine.

If you use Plug Machine's messaging functionality, you are responsible
for providing truthful and consistent registration information and
maintaining a live website, compliant opt-in process, privacy policy,
terms, campaign description, sample messages, and consent records when
required.

You may not circumvent carrier restrictions, rotate numbers to evade
enforcement, use misleading campaign descriptions, or send messages
inconsistent with the use case and consent submitted during
registration.

Registration approval does not mean that every future message or
business practice is compliant. You remain responsible for ongoing
compliance.

15. TELEPHONE AND VOICE SERVICES

If Plug Machine provides calling, voice, voicemail, recording,
artificial-intelligence voice, or telephone functionality, you are
responsible for complying with applicable consent, recording,
telemarketing, caller-identification, do-not-call, and other
telecommunications requirements.

You may not spoof caller identity unlawfully or use telephone
functionality to deceive, threaten, harass, defraud, or impersonate
another person.

Call quality, number availability, carrier routing, and
telecommunications uptime are not guaranteed.

16. ACCEPTABLE USE

You may not use Plug Machine to:

violate applicable law or regulation;

infringe intellectual-property, privacy, publicity, or other rights;

engage in fraud, deception, phishing, impersonation, or identity
theft;

transmit malware, malicious code, ransomware, or harmful software;

interfere with, disrupt, overload, or compromise the Services;

attempt unauthorized access to accounts, systems, networks, or data;

send spam or unlawful unsolicited communications;

evade consent, opt-out, carrier, platform, or provider requirements;

facilitate unlawful discrimination, harassment, threats, or abuse;

upload content you do not have the right to use;

resell, sublicense, copy, reverse engineer, or exploit protected
technology except as expressly permitted;

use the Services in a manner that exposes Plug Machine or its
providers to unreasonable legal, security, reputational, or
operational risk.

We may investigate suspected violations and take reasonable action to
protect the Services, users, providers, and public.

17. THIRD-PARTY SERVICES AND INTEGRATIONS

Plug Machine may connect with or rely upon third-party services,
including payment processors, communications providers, hosting
providers, social-media platforms, advertising platforms, domain
providers, email services, calendars, artificial-intelligence providers,
APIs, analytics providers, and other applications.

Third-party services are governed by their own terms and policies.

Plug Machine is not responsible for third-party outages, restrictions,
pricing changes, policy changes, account suspensions, security
incidents, data practices, service discontinuation, or performance.

You authorize Plug Machine to exchange information with third-party
services as reasonably necessary to provide integrations you enable,
subject to our Privacy Policy and applicable law.

18. PAYMENT PROCESSING

Payments may be processed by third-party payment processors.

By providing payment information, you represent that you are authorized
to use the payment method and authorize applicable charges.

Payment processors may collect and process payment-card, bank, billing,
fraud-prevention, and authentication information under their own terms
and privacy policies.

Plug Machine does not guarantee that a payment method, processor,
wallet, or payment feature will always remain available.

19. CUSTOMER CONTENT

"Customer Content" means information, text, images, videos, files,
contact records, websites, funnels, forms, campaigns, messages,
workflows, courses, products, and other material you submit to or create
through the Services.

As between you and Plug Machine, you retain ownership of Customer
Content you lawfully own.

You grant Plug Machine and its service providers a limited,
non-exclusive right to host, copy, process, transmit, display, modify as
technically necessary, back up, and otherwise use Customer Content
solely as reasonably necessary to operate, secure, support, improve, and
provide the Services or comply with law.

You represent that you have all rights and permissions necessary for
Customer Content and its use through the Services.

20. CUSTOMER CONTACT AND CLIENT DATA

Plug Machine may function as a technology platform through which
customers process information relating to their own prospects, contacts,
customers, members, or clients.

When you determine why and how such information is collected or used,
you are responsible for your own privacy notices, consent language,
data-processing practices, retention practices, access controls, and
legal obligations.

You should not use Plug Machine as a substitute for professional legal
advice regarding your business's privacy or compliance obligations.

21. INTELLECTUAL PROPERTY

The Plug Machine name, logos, branding, website, platform configuration,
proprietary materials, training, documentation, templates, graphics,
videos, course materials, processes, written content, and other
materials are owned by or licensed to Fearlyss LLC and are protected by
applicable intellectual-property laws.

Except for rights expressly granted under these Terms, no rights are
transferred to you.

You may not copy, distribute, sell, publish, reproduce, create
derivative works from, or commercially exploit proprietary Plug Machine
materials unless authorized in writing or permitted by applicable law.

22. LIMITED LICENSE

Subject to these Terms and payment of applicable fees, Plug Machine
grants you a limited, revocable, non-exclusive, non-transferable,
non-sublicensable right to access and use the Services for your
authorized business or personal purposes during the applicable access
period.

This license ends when your access or subscription ends, except for
materials expressly sold or licensed for continued use.

23. TEMPLATES, SNAPSHOTS, AND DIGITAL MATERIALS

Plug Machine may provide templates, workflows, snapshots, prompts,
forms, funnel structures, automations, scripts, documents, training
materials, or other resources.

Unless expressly stated otherwise, these resources are provided as
starting points and may require customization for your business.

You are responsible for reviewing and adapting materials before use. A
template labeled or described as "compliant," "A2P," "TCPA," "privacy,"
"terms," or similar does not constitute legal advice or a guarantee of
approval or compliance.

24. COMMUNITY FEATURES

If your plan includes a community, forum, group, chat, comment area,
live call, Q&A, or other interactive feature, you agree to behave
professionally and lawfully.

You are responsible for information you choose to disclose to other
community members.

We may moderate or remove content and may restrict participation for
conduct that violates these Terms, community rules, or reasonable
standards of safety and integrity.

25. EDUCATIONAL CONTENT

Courses, classes, Q&A sessions, workshops, tutorials, documentation,
examples, and other educational materials are for informational and
educational purposes.

Business, marketing, sales, funnel, automation, advertising,
artificial-intelligence, and technology strategies involve variables
outside Plug Machine's control.

We do not guarantee that educational content will produce any specific
result.

26. ARTIFICIAL INTELLIGENCE FEATURES

Certain Services may include or connect with artificial-intelligence
functionality.

AI-generated content may be inaccurate, incomplete, outdated,
inappropriate, or unsuitable for a particular purpose. You are
responsible for reviewing AI outputs before relying on, publishing,
sending, or implementing them.

You should not rely solely on AI output for legal, medical, financial,
tax, employment, safety-critical, or other professional decisions.

Availability and behavior of third-party AI models may change without
notice.

27. SUPPORT

Support availability, channels, response times, office hours, and
included support depend on your plan or agreement.

Unless expressly guaranteed in writing, support response times are
estimates and are not service-level guarantees.

Support does not include unlimited custom development, consulting, legal
review, marketing execution, or other work unless expressly included in
your purchase.

28. SERVICE AVAILABILITY

We aim to provide reliable Services but do not warrant uninterrupted,
timely, secure, or error-free access.

Services may be unavailable because of maintenance, updates,
telecommunications failures, internet failures, third-party outages,
cyber incidents, force majeure events, provider restrictions, or
circumstances outside our reasonable control.

We may perform maintenance and modifications without advance notice
where reasonably necessary.

29. DATA BACKUPS AND EXPORTS

Where available, you are responsible for maintaining appropriate copies
and backups of information important to your business.

Although the Services or providers may maintain backups for operational
purposes, Plug Machine does not guarantee that every item of Customer
Content can be recovered after deletion, corruption, termination,
provider failure, or other loss.

You should export important data before canceling or terminating your
account when export functionality is available.

30. SECURITY

You agree not to bypass, disable, probe, test, or interfere with
security controls except with express authorization.

You are responsible for reasonable security practices for your account,
users, devices, passwords, API credentials, integrations, and connected
services.

Notify us promptly at [email protected] if you reasonably suspect
unauthorized account access.

31. PRIVACY

Our collection, use, disclosure, and protection of personal information
is described in the Plug Machine Privacy Policy.

The Privacy Policy is incorporated into these Terms by reference where
permitted.

32. CONFIDENTIALITY

During use of the Services, either party may receive non-public
information reasonably understood to be confidential.

Each party agrees to use reasonable care to protect confidential
information and use it only for purposes related to the relationship,
except where disclosure is authorized, required by law, already public
through no breach, independently developed, or lawfully obtained without
confidentiality restrictions.

This section does not alter obligations concerning personal data under
the Privacy Policy or applicable law.

33. FEEDBACK

If you voluntarily provide suggestions, ideas, comments, feature
requests, or feedback about Plug Machine, you grant us permission to use
that feedback to operate and improve the Services without an obligation
to compensate you, provided we do not publicly identify you as the
source without permission where identification is not otherwise
apparent.

34. TESTIMONIALS AND PUBLICITY

We will not claim that you endorse Plug Machine merely because you use
the Services.

If you voluntarily provide a testimonial, review, case study, or
permission to use your name, business name, likeness, results, or
content for promotional purposes, such use will be governed by the
permission you provide and applicable law.

35. BUSINESS RESULTS DISCLAIMER

Plug Machine does not guarantee leads, sales, appointments, conversions,
revenue, profit, audience growth, advertising performance,
deliverability, approval, funding, customer retention, or any other
business outcome.

Results depend on numerous factors, including your offer, market,
pricing, execution, content, audience, reputation, advertising,
compliance, sales ability, economic conditions, and third-party
platforms.

Examples, testimonials, case studies, and educational illustrations are
not promises of future results.

36. PROFESSIONAL ADVICE DISCLAIMER

Plug Machine provides technology and educational resources and is not a
law firm, accounting firm, tax adviser, investment adviser, medical
provider, or other regulated professional adviser.

Nothing in the Services constitutes legal, tax, accounting, investment,
medical, or other regulated professional advice.

You should consult an appropriately qualified professional for advice
specific to your circumstances.

37. A2P AND REGULATORY APPROVAL DISCLAIMER

Plug Machine may provide educational resources or technical tools
intended to help customers configure consent forms, policies,
registration information, messaging campaigns, or telecommunications
settings.

However, carriers, The Campaign Registry, telecommunications providers,
payment providers, governmental authorities, and other third parties
make their own decisions.

Plug Machine does not guarantee A2P approval, toll-free verification,
message delivery, carrier acceptance, email deliverability, payment
approval, or continued access to a third-party service.

38. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL
RELATED CONTENT, SOFTWARE, MATERIALS, FEATURES, AND SUPPORT ARE PROVIDED
"AS IS" AND "AS AVAILABLE."

FEARLYSS LLC DBA PLUG MACHINE DISCLAIMS WARRANTIES NOT EXPRESSLY
PROVIDED IN WRITING, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY,
AVAILABILITY, AND RESULTS.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE,
COMPLETELY SECURE, OR FREE FROM HARMFUL COMPONENTS.

Some jurisdictions do not permit certain warranty exclusions, so
portions of this section may not apply to you.

39. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FEARLYSS LLC DBA PLUG
MACHINE AND ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES,
CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE
LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR
PUNITIVE DAMAGES OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL,
BUSINESS OPPORTUNITY, CUSTOMERS, OR ANTICIPATED SAVINGS ARISING OUT OF
OR RELATING TO THE SERVICES.

Nothing in these Terms excludes liability that cannot legally be
excluded or limited.

40. INDEMNIFICATION

To the extent permitted by law, you agree to defend, indemnify, and hold
harmless Fearlyss LLC dba Plug Machine and its owners, personnel,
affiliates, licensors, contractors, and service providers from claims,
liabilities, losses, damages, judgments, penalties, and reasonable costs
arising from or relating to your Customer Content, communications,
campaigns, products, services, unlawful conduct, violation of these
Terms, infringement of third-party rights, or failure to obtain required
permissions or consent.

41. SUSPENSION

We may suspend or restrict some or all Services when reasonably
necessary because of suspected fraud, abuse, security threats, unlawful
activity, nonpayment, excessive provider complaints, carrier
restrictions, third-party platform requirements, violation of these
Terms, or risk to Plug Machine, our providers, customers, or others.

Where appropriate, we may provide an opportunity to cure a violation,
but we are not required to do so where immediate action is reasonably
necessary.

42. TERMINATION

We may terminate access for material or repeated violation of these
Terms, nonpayment, unlawful use, fraud, abuse, security risks,
third-party provider requirements, or discontinuation of Services.

Upon termination, your right to use the affected Services ends.

Provisions that by their nature should survive termination---including
intellectual-property, payment obligations, disclaimers, limitations of
liability, indemnification, dispute provisions, and other accrued
rights---will survive.

43. EFFECT OF TERMINATION ON DATA

After termination or expiration, access to account data may end
immediately or after a limited retention period depending on the
applicable platform and service.

We are not obligated to retain Customer Content indefinitely after
termination unless required by law or expressly agreed in writing.

You are responsible for exporting data you need before termination where
possible.

44. CHARGEBACKS AND PAYMENT DISPUTES

If you believe a charge is incorrect, contact us at [email protected]
so we can investigate.

Initiating a chargeback does not automatically terminate contractual
obligations or establish that a charge was invalid.

We may suspend Services associated with disputed or reversed payments
while the matter is investigated, to the extent permitted by law.

Nothing in this section limits legally protected payment-dispute rights.

45. TAXES

Prices may exclude applicable sales, use, telecommunications, excise,
value-added, or similar taxes unless expressly stated otherwise.

You are responsible for taxes applicable to your purchase except taxes
imposed on Plug Machine's net income, subject to applicable law.

46. EXPORT AND SANCTIONS COMPLIANCE

You may not use the Services in violation of applicable export-control,
sanctions, or trade-restriction laws.

You represent that your use of the Services is not prohibited by
applicable sanctions or export restrictions.

47. ACCESSIBILITY

Plug Machine seeks to provide usable digital experiences. If you
encounter an accessibility issue with our website or Services, contact
[email protected] so we can review the issue.

48. COPYRIGHT COMPLAINTS

If you believe content available through Plug Machine infringes your
copyright, you may contact [email protected] with sufficient

49. GOVERNING LAW

These Terms are governed by the laws of the Commonwealth of Virginia,
without regard to conflict-of-law principles, except where applicable
law requires otherwise.

Nothing in these Terms deprives a consumer of mandatory protections that
cannot lawfully be waived.

50. DISPUTES

Before filing a formal claim, you and Plug Machine agree to make a
reasonable good-faith effort to resolve the dispute informally by
contacting the other party and describing the issue and requested
resolution.

Nothing in this section prevents either party from seeking urgent relief
where legally appropriate or exercising rights that cannot legally be
restricted.

Any forum-selection or dispute-resolution requirement will apply only to
the extent enforceable under applicable law.

51. FORCE MAJEURE

Plug Machine will not be responsible for delay or failure caused by
circumstances beyond our reasonable control, including natural
disasters, severe weather, war, terrorism, civil unrest, labor disputes,
government actions, epidemics, internet failures, power failures,
telecommunications failures, cyberattacks, carrier outages,
cloud-provider outages, or third-party platform failures.

52. ASSIGNMENT

You may not assign or transfer these Terms or your account in a manner
that would circumvent account, licensing, compliance, or eligibility
requirements without our consent.

Plug Machine may assign these Terms in connection with a merger,
acquisition, corporate restructuring, financing, or sale of all or
substantially all relevant business assets, subject to applicable law.

53. NO WAIVER

Failure to enforce a provision of these Terms does not waive our right
to enforce that provision or another provision later.

54. SEVERABILITY

If a provision of these Terms is found invalid or unenforceable, it will
be enforced to the maximum extent permitted, and the remaining
provisions will remain in effect unless applicable law requires
otherwise.

55. ENTIRE AGREEMENT

These Terms, the Privacy Policy, applicable order forms, checkout terms,
written proposals, and other agreements expressly incorporated by
reference constitute the agreement governing your use of the applicable
Services.

If a separately signed written agreement expressly conflicts with these
Terms, the signed agreement controls to the extent of that conflict for
the Services it covers.

56. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our
Services, legal requirements, provider requirements, business practices,
or other circumstances.

The updated Terms will be posted with a revised "Last Updated" date.
Where required by law, we will provide additional notice.

Your continued use after updated Terms become effective constitutes
acceptance to the extent permitted by law.

57. ELECTRONIC COMMUNICATIONS

You consent to receive agreements, notices, disclosures, receipts, and
other communications electronically where permitted by law.

Electronic communications satisfy legal writing requirements to the
extent permitted by applicable law.

Your separate consent to receive marketing SMS messages is governed by
the SMS provisions above and the consent presented at opt-in.
